Terms and Conditions

 

  1. CONTRACT OBJECT

The purpose of this document is to regulate the terms and general conditions of contracting by the User of the online reservation services offered by www.uep.app (or UEPTransfers), a brand owned by UEP TRANSFERS S.L., a company registered in Spain with CIF: B-10617975 and registered office at Pere Martell 44 , 07003, Palma de Mallorca, Spain, and complement what is already established regarding the general conditions contained in the Legal Notice of the website, to which they refer in what is not stipulated in these reservation conditions.

Access and/or use of the website www.uep.app by the user is conditioned to the prior complete, express, and unconditional acceptance of these general conditions at the time of access, which will govern the terms of service provision. It is strongly recommended that the user read and keep a copy of these conditions, as they may have changed since the user's last access, and in any case, if more than fifteen days have passed since the last access.

 

  1. IDENTIFICATION OF THE PARTIES

On one hand, the owner of the WEBSITE: The entity UEP TRANSFERS S.L is responsible for and the owner of the website www.uep.app with these general conditions applicable to access to the WEBSITE and to the contracting, through the WEBSITE, of transportation services offered by third parties (providers) within it.

On the other hand, the USER: The one who accesses the WEBSITE to get information and, if applicable, hire the services offered by the WEBSITE, who declares to be of legal age, that is, over 18 years old, and legally capable of contracting according to Spanish civil law, as well as having read and accepted these general conditions.

UEP Transfers, SL acts as an intermediary, acting as an agent for the provider, offering interested companies a platform to showcase their services, through which customers (users) can hire them.

 

  1. APPLICATION

These terms and general conditions govern the relationships between users and UEP Transfers, and users have the terms and conditions governing a specific service available at the time of booking, between the user and the provider. UEP Transfers will not be liable for any liability arising from the services contracted between users and providers.

 

  1. BOOKING CONDITIONS

 

  1. The User, by using this WEBSITE to make a reservation, accepts these General Conditions, declaring to be in agreement with them.

 

  1. The User is responsible for the accuracy of the data provided when registering as a customer, with such data being complete.

 

  • The User will be responsible for the information provided at the time of booking, including names, dates, times, and routes. It is the User's responsibility to verify that all details of the reservation are correct before the trip and to inform UEP Transfers in advance if there is any error. If there is an error in the information provided by the user and as a result, the reservation incurs a change in the price of the services, the user will be responsible for that expense. If they do not pay the difference due to the incorrect information provided, UEP Transfers or the provider reserves the right to cancel the services without any compensation or refund liability.

 

  1. The User undertakes to promptly notify any modification of the reservation details.

 

  1. The User declares that the credit or debit cards used to make the reservation are in their ownership and have sufficient funds to cover the total amounts of the reservation.

 

  1. The User completing the reservation form must be authorized to do so on behalf of all members of the group included in the reservation.

 

  • The User is obligated to use any graphical material in compliance with the current and applicable data protection legislation, regulated in the European Union Regulation 2016/679 of the European Parliament and of the Council of April 27, 2016, and, in particular, in Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights.

 

  • UEP transfers will not be directly or indirectly responsible for the information entered by users, collaborators, and third parties, nor for the User's infringement of intellectual and industrial property rights, rights to honor, personal and family privacy, and the image of individuals (photographs), property rights, and any other nature belonging to a third party as a result of the transmission, dissemination, storage, provision, reception, acquisition, or access to the content.

 

  1. The user undertakes to use the services offered through the website www.uep.app in accordance with the law, good faith, and the customs and practices of the Internet, committing not to use the services for illegal purposes, prohibited in these general conditions, harmful to the rights and interests of third parties, or that may in any way damage, disable, overload, or deteriorate the services offered.

 

  1. The User is responsible for verifying the established pickup time and ensuring they arrive at the airport or port with sufficient time to check in and travel. The services will be provided according to the information provided and sent via email. It is the User's responsibility to provide accurate and complete addresses for pickup and destination at the time of booking. It is also the User's responsibility to print and verify the accuracy of the transfer voucher. If the information contained in the voucher is incorrect, they must immediately contact our Customer Service team to correct it. Neither UEP Transfers nor the providers will be responsible for bookings that cannot be carried out due to insufficient or incorrect information provided by the User, and in no case will such bookings be refunded.

 

 

  1. RESERVATION PROCESS

Reservations can be made through the website, mobile application, or by phone. If the reservation is made for two or more people, it is considered that the person making the reservation ("the Main Party") has done so on behalf of all passengers and accepts these terms and conditions on behalf of any passenger in the reservation. The Main Party must be at least 18 years old.

 

The reservation will be formalized by the full payment. Once the payment is received, UEP Transfers will process the reservation and after confirmation will send the User the details of the transfer services they have booked and the booking voucher. The voucher acts as a 'ticket or voucher' and must be presented to the provider's representative or driver.

 

UEP Transfers reserves the right to accept reservations by depositing part of the service price, provided that the reservation is made at least 20 days before the service date. Payments made as a deposit will not be refundable once the reservation is confirmed. The remaining balance will be deducted automatically 7 days before the service date using the same credit/debit card used to pay the initial deposit. If the user cancels the reservation 8 days before the first service date, the remaining balance will not be deducted from their credit/debit card, and the deposit will not be refunded.

The formalization of the reservation, through full payment, will constitute the user's contracting of the service with the provider.

  1. COMMON TERMS OF TRANSFER SERVICES

UEP Transfers providers operate on the island of Mallorca. The itinerary to your destination and all information published on the WEBSITE, such as route maps, are for informational purposes only.

UEP Transfers requires providers to make their best effort to adhere to pickup and delivery times, but these cannot be guaranteed.

If the User does not find the driver at the time of pickup, they must immediately call the provider at the phone number listed on the transfer voucher. If the customer arranges alternative transportation without prior communication, the provider will be released from their obligation to provide the service, and no refund will be issued.

If the driver of your private transfer cannot reach you, they will call the mobile phone number provided in the reservation. You must travel with that mobile phone turned on. If the driver cannot reach you at the provided phone number, the service cannot be performed, and no refund will be given.

Unused transfers are non-refundable, and costs for alternative transportation will only be reimbursed if authorized, with the corresponding receipt provided. Without the receipt, no refund will be processed.

If access to the destination via the usual route is closed due to weather conditions, traffic accidents, etc., the provider will, after consulting with the customer, take an alternative route to reach the agreed destination, which may incur additional costs to be borne by the customer.

If for justified reasons, such as construction work, it is not possible to access the pickup or destination point, an alternative point as close as possible will be agreed upon.

In case of any incident that makes the customer anticipate not being able to be at the designated meeting point at the specified time in the reservation, they must contact the provider using the contact phone number provided in their booking voucher.

All contracted transportation services are covered by the provider's liability insurance or the company subcontracted by them.

In the event that UEP Transfers or the provider is required to pay a deposit or a fine to authorities as a result of the customer's violation of laws, regulations, or other requirements of the countries they intend to enter, exit, or cross, the customer assumes full responsibility to reimburse UEP Transfers or the provider for such amounts.

Making a reservation implies authorization to charge any fines or damages caused to the transfer vehicle (including special cleaning) or for any missing items in the vehicle from the customer's provided credit or debit card.

UEP Transfers reserves the right to refuse further bookings from a customer who has caused a significant incident or repeated incidents.

 

  • PASSENGER CONDUCT

The company and the provider reserve the right to refuse service to any passenger who, according to the driver's criteria:

  • Is under the influence of alcohol or drugs.
  • Exhibits dangerous behavior towards the vehicle driver, third parties, or themselves.

Alcoholic beverages are not allowed to be consumed in the provider's vehicles during the journey. This prohibition also applies to drugs. Smoking or eating inside the vehicle is not permitted.

 

  • VEHICLES

In certain situations, the vehicle selected by the user may be replaced with one of higher capacity or multiple vehicles, depending on availability. If the change results in a lower category or smaller vehicle with a cheaper rate, the price difference will be refunded. Changes to higher-category vehicles at the provider's initiative will not incur additional charges for the user.

All vehicles provided by the providers are fully insured against third-party damage as required by local law.

 

  • LUGGAGE

Vehicles used for private transfers have space for at least 1 medium suitcase per passenger seat, not exceeding 70 cm x 50 cm. At the time of booking, the user must inform about the luggage to be transported. Smaller luggage items such as cameras, handbags, or small backpacks do not need to be declared. The user will be responsible for costs incurred if additional vehicles are needed for undeclared luggage.

The user should not include in their luggage or personal items any objects that violate the laws of the country where the service is provided (firearms, etc.) or those that could be harmful to third parties, or objects that are excessively large, heavy, or fragile.

The transport of luggage and other personal items is at your own risk and responsibility; UEP Transfers will not be liable for any damage or loss.

 

  • MINORS

The user is responsible for knowing local legislation when traveling with children. In some destinations, children must use appropriate baby or child seats. The user is responsible for providing all necessary information correctly at the time of booking, and they should include the necessary extras to comply with the laws of the service location.

Each provider will determine if these extras are offered for free or with an associated cost.

All children and babies, regardless of age, are considered when determining the vehicle's capacity and therefore must be included in the total number of passengers at the time of booking. Neither UEP Transfers nor the providers will be responsible for any incidents arising from the misuse or incorrect installation of the child restraint system. In some cases, child seats or boosters may be used, so the user should select the desired option when making the reservation to notify the provider.

For large groups, transfers may be conducted in minibuses or coaches where child seats cannot be used.

In certain cases, child seats may not be available. In such cases, the cost of the extra will be refunded. If the reserved child restraint systems are not available, children over the age of three must use a seatbelt. Children under the age of three can travel without a restraint system, only in the rear seats of the vehicle.

 

  • PASSENGERS WITH DISABILITIES

In some destinations, UEP Transfers, through its providers, offers transport services for people with disabilities or reduced mobility. If booking a vehicle of this type, the user is responsible for ensuring that the reserved vehicle perfectly meets the needs of the travelers. We recommend contacting our customer service department before booking such a vehicle so they can help you choose the one that best suits the needs of all passengers.

 

  • ANIMALS

Unless explicitly agreed otherwise or it's an assistance dog, animals are not allowed.

 

  1. RESERVATION MODIFICATIONS

 Modifications to reservations can be made up to 24 hours before the first service's use in any confirmed reservation. Changes made with less than 24 hours' notice before the first service use must be made by sending an email from the same email address provided at the time of booking to: bookings@uep.app, providing the reservation reference number, passenger's name, and the changes needed. Modifications may incur additional charges, and if they do, these charges must be paid before changes are made.

Modifications cannot change the destination specified in your reservation. Only pickup and delivery times and extras can be modified.

 

  1. CANCELLATIONS

Cancellations must be made through the website, the app, or by sending an email to bookings@uep.app. If the User cancels their reservation more than 24 hours before the date of the first confirmed service in the reservation, a full refund will be provided. If the reservation is canceled with less than 24 hours' notice before the date of the first confirmed service, no refund will be granted. If the User opted to make their reservation with a deposit payment, and if the reservation is canceled 8 days before the first service's usage date, the remaining balance will not be charged to their credit/debit card, and the deposit will not be refunded. All deposit payments made are non-refundable once the reservation is confirmed. If the services are not used for any reason and the reservation is not canceled, no refunds will be provided. All refunds will be debited to the original form of payment and the account used at the time of booking.

 

8.1. CANCELLATIONS BY UEPTRANSFERS OR THE PROVIDER

In extraordinary cases, if our provider is compelled to make significant changes to the service conditions or cancel them, UEP Transfers will strive to provide viable alternative measures for any confirmed reservations. If the reservation must be ultimately canceled, the full amount of the reservation will be refunded, covering all obligations to the customer arising from such cancellation.

 

  1. COMPLAINTS OR CLAIMS

If the service received from the provider does not meet expectations, it should be immediately reported to our Customer Service, and ideally at the time of the incident.

First, contact the local provider using the contact details provided in the booking confirmation, and they will assist in resolving any concerns. You will find their detailed contact information in the booking confirmation.

Written complaints should be sent via email to info@ueptransfers.com.

 

  1. NOTIFICATIONS

All notifications, requirements, requests, and other communications that UEP Transfers needs to make to the User in relation to these general conditions and/or the provision of services and product offerings will be made by email and will be considered properly executed when sent to the email address provided in the User's reservation.

Regarding notifications, requirements, requests, and other communications that the User needs to make to UEP Transfers in relation to these general conditions and/or the provision of services and product offerings, they will be made by email and will be considered properly executed when sent to the following email address: info@ueptransfers.com.

  1. ENTIRE AGREEMENT

The User declares to have read, accepted, and fully understood the general conditions.

 

  1. MODIFICATIONS

UEP Transfers cannot modify these general conditions at any time unless the User has been previously informed of such changes.

If the User has been informed, any resulting modifications will be published on the website www.uep.app for the purpose of notifying Users and will not affect bookings made prior to the modification.

 

  1. APPLICABLE JURISDICTION

These General Contracting Conditions are subject to the provisions of the following laws:

  • Law 7/1998, of April 13, on General Contracting Conditions.
  • Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16.
  • Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data.
  • Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights.
  • Law 34/2002, of July 11, on Information Society Services and Electronic Commerce.

To resolve any discrepancies or claims that may arise from the interpretation or execution of the legal relationship between the User and UEP Transfers, the parties shall be subject to mandatory rules on judicial jurisdiction.

 

  1. DATA PROTECTION

In compliance with the Data Protection Regulation, the User is informed that the personal data provided to UEP Transfers through the acceptance of these general conditions, as well as any data provided in the future as a result of their relationship with UEP Transfers, will be incorporated into a file owned by the latter, whose identifying information is stated in these conditions, for the purpose of providing the services offered on the UEP Transfers website, as well as sending commercial communications about products and services that the company owning the file may offer, to which the User expressly consents, being responsible for the accuracy of the provided data and committing to immediately communicate any changes that may occur.

In this sense, the user can access their account and update or correct the provided data.

The user is informed that they can object to the processing of their data and must communicate this to the file owner.

In accordance with the Data Protection Regulation, you are informed that regarding the personal data collected for processing, you have the possibility to exercise the following rights:

by sending a written request to the file owner in accordance with the applicable legislation.

Furthermore, in accordance with the Data Protection Regulation, and given that, for the provision of the services contracted with UEP Transfers, it is necessary for UEP Transfers to access the personal data files for which the organizer is responsible, said data processing will be carried out in accordance with the following considerations:

  1. Access by UEP Transfers to the data owned by the data controller will not be considered a data communication. UEP Transfers will only process the data in accordance with the instructions of the data controller.

Access by UEP Transfers to personal data contained in files owned by the data controller will be done solely and exclusively for the purpose of fulfilling the contract's assignment, so that the processor can provide the data controller with the agreed services.

In no case may UEP Transfers apply or use personal data and files owned by the data controller and provided to be processed, or those resulting from the provision of the service, for purposes other than those envisaged in the contract.

 

  1. b) UEP Transfers is obliged to implement the necessary technical and organizational measures referred to in the Data Protection Regulation to guarantee the security and integrity of personal data and prevent their alteration, loss, processing, or unauthorized access, taking into account the state of the technology, the nature of the stored data, and the risks to which they are exposed, whether from human action or from the physical or natural environment.

Once the contractual performance has been fulfilled, and at the time when, in compliance with the agreed or legally stipulated conditions, the relationship between both parties ends, the personal data used by UEP Transfers must be destroyed. The same will apply to any support or documents containing personal data subject to processing.
